3 Reasons Firms Hesitate
Why use RCReports when I can just use Google to search for a salary?
The information you find in a quick internet search will be difficult to defend in an IRS audit or in litigation of any kind where the reasonable compensation figure is challenged. One of the primary factors that will be assessed is whether your source of information uses unbiased data. This means that it must properly represent the entire population and cannot over or under estimate certain groups within the population. When using sites commonly found via an internet search, there is in effect, no way to prove that the data is unbiased. RCReports data meets strict confidence levels and is supported by our team of data scientists to ensure your numbers are backed by unbiased data. Methodology reports are available upon request to further strengthen your defensible position should your figure be challenged in audit or litigation.
In addition to the data sources used, an internet search does not take into account the approved IRS approaches and methodologies for calculating reasonable compensation. These are the approaches that an IRS examiner will use if they challenge a reasonable compensation figure. The RCReports platform includes these three approaches so that you’re using the same methodologies as the IRS.
I want to use RCReports but it’s too expensive.
The IRS can, and will, issue preparer penalties if they feel you’ve signed off on an unreasonable salary for an S Corp shareholder. Those preparer penalties are up to $5,000 per client, per year. We have never heard of a preparer penalty being assessed when our report is used to calculate the reasonable compensation figure. How will I get my clients to agree?
We do advocate for you to have a discussion with your clients, but we do not recommend leaving the decision up to them on whether or not they want to document reasonable compensation and have an analysis done. Whether you use RCReports or not, you, as the CPA and trusted advisor, need to have a defensible position if you sign off on your clients’ taxes. If you don’t have proper documentation, you can be hit with a preparer penalty of $5,000 or more. The IRS does not care what your client agreed to or disagreed to, they care if you, the trusted advisor, took the necessary steps to properly document reasonable compensation. Your client is also at a huge risk if they don’t have proper documentation to back up their reasonable compensation figure. Even if their reasonable compensation is accurate, without a defendable report, they are vulnerable to the often hefty fees associated with an IRS audit.
